Giveaway

1. Scope

These terms and conditions apply to all giveaways conducted by RAD RACE GmbH, Fischmarkt 9, 22767 Hamburg, in connection with the event brand “99 LAPS”. By participating, each participant accepts these terms and conditions.

This giveaway is in no way connected to Instagram. It is neither sponsored, supported, nor organized by Instagram and does not establish any legal claims against Instagram. All information related to this giveaway is provided exclusively by the organizer.

 

2. Participation

 

2.1

Any natural person aged 18 or older is eligible to participate. Participants who are at least 16 years old but not yet of legal age may only participate with the consent of their legal guardians.

 

2.2

Persons under the age of 16 and individuals who are legally incapable are excluded from participation.

 

2.3

The organizer reserves the right to exclude persons from participation who violate these terms and conditions or attempt to gain an advantage through improper influence or manipulation. In such cases, the organizer may also retroactively disqualify participants, revoke and reclaim any prizes.

 

2.4

Participation is only possible within the time period stated in the giveaway description. Each participant may enter an identical giveaway only once.

 

2.5

Employees of the organizer and employees of companies involved in the giveaway, as well as their immediate family members, are excluded from participation.

 

3. Execution of the Giveaway

 

3.1

Participation requires following the Instagram account @99laps. If further conditions apply, they will be specified in the giveaway entry instructions. The giveaway will be conducted within the announced time frame. All participants who meet the stated conditions by the time of the draw will be considered. After the participation deadline, the winner will be selected at random.

 

3.2

Cash payment or exchange of the prize is excluded. The prize is non-transferable.

 

4. Prize Fulfillment

 

4.1

The winner will be notified via email (mail@99laps.com), Instagram direct message (@99laps), or another electronic means by the organizer. The notified participant must inform the organizer within one month whether they accept the prize. If no response is received, the prize will be forfeited and another participant will be notified.

 

4.2

Incorrect contact details are the responsibility of the participant.

 

4.3

If delivery of a physical prize fails, the organizer will attempt to resolve the issue with the shipping service provider. However, there is no entitlement to the prize in such a case.

 

5. Defect Liability

The organizer is liable only in cases of willful misconduct, fraud, or gross negligence for damages caused by material or legal defects in the prize. Any further liability is excluded.

 

6. Premature Termination, Adjustment, or Modification of the Giveaway

The organizer reserves the right to terminate or modify the giveaway at any time without notice if proper execution is not possible for technical or legal reasons.

 

7. Applicable Law

All legal relationships are governed by the law of the Federal Republic of Germany. For consumers, this choice of law only applies insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

8.1 Processing of Personal Data

We process your personal data solely for the purpose of conducting the giveaway and delivering the prize. The participant’s profile name and full name will be collected. The winner’s address will be collected for shipping the prize. Data will only be shared with third parties for the purpose of prize delivery.

 

8.2 Data Retention Period

After the giveaway ends, all personal data processed for the giveaway will be deleted no later than three months after the end of the giveaway, unless the participant has consented to further use (e.g., newsletter subscription).

 

8.3 Data Subject Rights

You have the right to access, rectify, delete, or restrict processing of your data, as well as the right to object and to data portability in accordance with the GDPR. You also have the right to lodge a complaint with a supervisory authority.
